These Terms of Service (“Terms”) govern your access to and use of SpizeBox’s website and services (the “Site”), operated by SpizeBox, LLC (“SpizeBox,” “we,” “us,” or “our”). By accessing or using the Site to browse or purchase spices, pantry items, and related products (“Products”), you agree to be bound by these Terms. If you do not agree, you may not use the Site.


1. Definitions

  • “User,” “you,” or “your” means any individual or entity accessing or using the Site.
  • “Account” means a User’s registered profile on the Site.
  • “Order” means your offer to purchase Products through the Site, subject to our acceptance.

2. Eligibility

You must be at least 18 years old and legally capable of entering into binding contracts to use the Site and place Orders. By creating an Account and placing an Order, you represent and warrant that you meet these requirements.

3. Account Registration

  1. Information Accuracy: You agree to provide and maintain current, complete, and accurate information during registration and thereafter.
  2. Security: You are responsible for safeguarding your Account credentials and for all activities that occur under your Account. Notify us immediately of any unauthorized use.

4. Products, Pricing & Availability

  1. Descriptions: We strive to accurately display Product images, descriptions, and prices, but do not warrant that all information is error-free.
  2. Prices: All prices are quoted in U.S. dollars. We reserve the right to change prices without prior notice. Orders are charged at the price in effect at the time we accept your Order.
  3. Availability: Product availability is subject to change without notice. If an ordered item is out of stock or discontinued, we will notify you and either suggest an alternative or cancel the Order for a full refund.

5. Orders & Payment

  1. Order Acceptance: Your Order constitutes an offer to purchase under these Terms. We reserve the right to accept or decline your Order for any reason (e.g., stock unavailability, pricing errors).
  2. Payment Methods: We accept payment via major credit cards, debit cards, and other payment methods displayed at checkout. By providing payment information, you represent that you are authorized to use that payment instrument.
  3. Taxes & Fees: Applicable sales taxes are calculated and added at checkout based on your shipping address. You are responsible for any import duties or customs fees on international shipments.

6. Shipping & Delivery

  1. Shipping Methods: We offer various shipping options. Estimated delivery times are provided at checkout but are not guaranteed.
  2. Risk of Loss: Title and risk of loss for all Products pass to you upon our delivery to the carrier.
  3. Address Accuracy: You are responsible for providing the correct shipping address. We are not liable for delays or losses due to incorrect addresses.
  4. Delivery Estimates: Delivery windows are provided for convenience only. Actual delivery times may vary due to carrier delays, weather events, natural disasters, or other unforeseen circumstances. SpizeBox shall not be liable for any delay in delivery.

7. Returns, Exchanges & Cancellations

  1. Return Policy: If you receive a defective or incorrect item, contact us within 14 days of delivery for a replacement or refund. We may require photo evidence.
  2. Expired-Item Policy: Please inspect the expiration date on every Product upon delivery. If you discover that an item is expired or will expire within 30 days of receipt, contact us immediately at support@spizebox.com with a photo of the expiration date. We will facilitate a full refund or replacement at no additional cost.
  3. Change of Mind: Requests to cancel or return non-defective Products due to change of mind must be made within 7 days of delivery; you may be responsible for return shipping costs and a restocking fee.
  4. Refunds: Refunds are issued to the original payment method within 5–7 business days after we receive the returned Product, less any applicable fees.

8. Privacy Policy

Your use of the Site and our handling of your personal data are governed by our Privacy Policy, which is incorporated herein by reference.

9. Intellectual Property

All content on the Site—including text, graphics, logos, images, and software—is our property or licensed to us and protected by U.S. and international copyright, trademark, and other laws. You may not reproduce, distribute, or create derivative works without our express written permission.

10. User Conduct

By using the Site, you agree not to:

  • Violate any applicable law or regulation.
  • Infringe any third-party rights.
  • Transmit viruses or malicious code.
  • Interfere with or disrupt the integrity or performance of the Site.
  • Harvest personal data or send unsolicited communications.

11. Third-Party Links & Services

The Site may contain links to third-party websites, payment processors, and services. We do not endorse and are not responsible for their content, practices, or terms. Your interactions with third parties are solely between you and that third party.

12. Compliance & Product Liability

  1. Food-Safety Compliance: We comply with all applicable U.S. food-safety regulations (FDA, USDA).
  2. Disclaimer: Products sold are for retail consumption. We make no warranties as to any health benefits or outcomes. You assume all responsibility for proper handling and storage of food products.

13. Product Recalls & Safety Alerts

  1. Notification: If any Product you have purchased is subject to a safety recall or similar alert, we will use the contact information in your Account to notify you promptly of the recall details and any required actions.
  2. Your Responsibilities: Upon receipt of a recall notice, you must immediately discontinue use of the affected Product and follow all instructions in the notice (e.g., disposal, return, or quarantine).
  3. Returns & Refunds: We will facilitate returns of recalled Products at no cost to you and issue a full refund or replacement once the recalled items are received or confirmed destroyed, per the recall instructions.
  4. No Liability for Non-Compliance: SpizeBox shall not be responsible for any damages, injuries, or losses arising from continued use of a Product after you have been notified of a recall.

14. Accessibility

We strive to make our Site accessible to all users and follow applicable standards such as the Americans with Disabilities Act (ADA). Please contact support@spizebox.com if you encounter any accessibility barriers.

15. Security Measures & Data Breach Notification

  1. Robust Protections: We employ industry-standard safeguards—including encryption in transit and at rest, secure coding practices, regular vulnerability assessments, and multi-factor authentication—to protect your data on our systems, on vendor platforms, and within any open-source components we use.
  2. Vendor & Third-Party Risk Management: We conduct due diligence and require contractual security commitments from all vendors, payment processors, and third-party service providers.
  3. Breach Response: In the unlikely event of a security breach or “cypher attack” affecting our systems or those of our vendors, we will:
    • Promptly notify you via the email address on your Account;
    • Detail the nature of the breach, the data types involved, and recommended steps you can take to protect yourself;
    • Provide complimentary identity-theft protection services or other remedies if personal data was exposed.
  4. Limitations: While we commit to continuous monitoring and rapid response, no system can be 100% immune. SpizeBox’s liability for any breach shall be subject to the limitations in Section 17.

16. Disclaimers & Warranties

THE SITE AND ALL CONTENT, PRODUCTS, AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. SpizeBox DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

17. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL SpizeBox OR ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY IN CONNECTION WITH THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE SIX (6) MONTHS PRIOR TO THE CLAIM.

18. Indemnification

You agree to indemnify, defend, and hold harmless SpizeBox and its affiliates, officers, directors, employees, and agents from and against all claims, liabilities, losses, and expenses (including reasonable attorneys’ fees) arising from your violation of these Terms or your use of the Site.

19. Force Majeure

Neither party will be liable for delays or failures in performance resulting from causes beyond its reasonable control, including acts of God, war, terrorism, strikes, pandemics, government orders, or electrical or Internet outages.

20. Dispute Resolution; Arbitration & Class-Action Waiver

  1. Arbitration: You and SpizeBox agree to resolve any dispute by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. Judgment on the award may be entered in any court of competent jurisdiction.
  2. Class-Action Waiver: YOU AND SPIZEBOX AGREE THAT ANY ARBITRATION SHALL BE CONDUCTED ON AN INDIVIDUAL BASIS ONLY AND NOT IN A CLASS, CONSOLIDATED OR REPRESENTATIVE ACTION.

21. Governing Law & Venue

These Terms are governed by the laws of the State of [Your State], without regard to conflict-of-law principles. The exclusive venue for any court proceedings arising out of these Terms (outside of arbitration) shall be in the federal or state courts located in the state of Indiana.

22. Modifications to These Terms

We reserve the right to modify these Terms at any time. Updated Terms will be posted with a new “Effective Date.” Continued use of the Site after changes constitutes your acceptance of the revised Terms.

23. Severability

If any provision of these Terms is held invalid or unenforceable, the parties will negotiate in good faith to substitute a valid, enforceable provision that most closely approximates the intent of the original. The remaining provisions will remain in full force and effect.

24. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published on the Site, constitute the entire agreement between you and SpizeBox regarding the Site and supersede all prior or contemporaneous communications.
